Home buyers should be very wary of tenants. Ask direct questions about how long they've been living there, what rental they are paying and the status of their notice to vacate the property.
Clive Ashpol of the Estate Agency Affairs Board said first time home buyers Mary Jerry and Joe Wanjigi's situation was "unfortunately all too prevalent".
In terms of common law, he said, the seller had to ensure that the purchaser obtained the "full beneficial ownership" and occupation of the property that had been bought in good faith.
